First Meeting of Creditors Scheduled; Bar Date by which to File Proofs of Claim Set
On 10/13/10, the Bankruptcy Court entered a Notice scheduling the Debtor’s First Meeting of Creditors for Friday, November 12, 2010, at 11 a.m. in Bankruptcy Court Conference Room B110, U.S. Courthouse, 17 South Park Row, Erie. The Notice also set the deadline for all creditors to file a proof of claim in the Bankruptcy Case for February 10, 2011.

Deadlines Set for Objections to Entry of Final Order Approving Debtor’s Use of Cash Collateral and Motion for Authority to Partially Distribute Sale Proceeds
On 10/21/10, the Bankruptcy Court entered a Consent Order Authorizing Use of Cash Collateral (“Order”) by and between the Debtor and Mercer County State Bank. Concurrently therein the Court also scheduled a hearing on the final entry of the Order for 11/4/10 at 11:00 a.m. in the Bankruptcy Courtroom, U.S. Courthouse, 17 South Park Row, Erie, with objections to the Order due by 11/1/10.
Also on 10/21/10 the Bankruptcy Court entered Orders granting the Debtor’s Motion for Order Authorizing Pre-Petition Employee Wages and Taxes, the Debtor’s Motion for Order Authorizing Use of Pre-Petition Bank Accounts, Business Forms, Stationary and Checks, and certain Orders approving the Debtor’s Motion to Determine Adequate Assurance of Payment of Utilities.
In addition, on 10/22/10 the Bankruptcy Court scheduled a hearing on the Debtor’s Motion for Authority to Partially Distribute Sale Proceeds for 11/18/10 at 9:30 a.m. in the Bankruptcy Courtroom, U.S. Courthouse, 17 South Park Row, Erie, with objections to the Motion due by 11/10/10. By the Motion, the Debtor seeks authority to distribute proceeds received from the public auction of certain personal property of the Debtor that occurred on or about 9/15/10-9/16/10, to those creditors holding first liens on the individual pieces of equipment. The auction yielded net proceeds in the amount of $288,635.00 and was confirmed by Order of the Bankruptcy Court entered on 10/1/10. Pursuant to the terms of the motion, the Debtor would distribute a total of $126,736.00 to the lienholders, while retaining $161,899.00, of which $81,534.00 constitutes proceeds from the sale of equipment upon which Mercer County State Bank asserts a first priority lien and of which $80,365.00 constitutes proceeds from the sale of equipment that was not encumbered by liens.

Welcome to the information website for creditors of W.L. Dunn Construction Co. ("Debtor"). The Debtor filed a voluntary Petition for Relief under Chapter 11 of the Bankruptcy Code on September 3, 2010, in the Bankruptcy Court for the Western District of Pennsylvania, Erie Division.
On October 15, 2010, the Office of the United Stated Trustee for the Western District of Pennsylvania formed the Official Committee of Unsecured Creditors of W.L. Dunn Construction Co. pursuant to 11 U.S.C. § 1102. Members of the Committee include Allegheny Mineral Corp., Armstrong Cement & Supply Corp., Herbal Insurance Agency, t/a Wagner-Giblin Insurance Agency, and Klasen Oil Co.
Also on October 15, 2010, the Committee held a meeting at which it elected Allegheny Mineral Corp. as Chair. Thereafter, the Committee voted to engage the Quinn Law Firm as counsel to represent it in these proceedings. Quinn’s retention application was filed on October 19, 2010. Any objections or responses to the application are due by November 10, 2010, and a hearing scheduled for November 18, 2010.
